Thinky Creates Terms of Service — last updated 13 September 2026

These terms govern use of the Thinky OS platform and its modules (the "Service") provided by Thinky Trading and Marketing W.L.L., Doha, Qatar, trading as Thinky Creates ("Thinky"). By creating an account or using the Service you agree to them.

1. The Service. Thinky OS is a hosted software platform for retail businesses, delivered as an isolated instance per Customer, with optional modules (for example Thinky Connect for customer messaging, Thinky HR, Thinky ERP and Thinky Management). Features available depend on the modules and package subscribed.

2. Accounts. Customers are responsible for their users, for keeping credentials confidential, and for all activity under their accounts. Customers must provide accurate business information and keep it current.

3. Customer content and data. Customers retain all rights to their data. Customers grant Thinky the right to host, process and transmit that data solely to provide the Service. Customers are responsible for having a lawful basis to message their shoppers, for obtaining any required consents, for honouring opt-outs, and for the content they send.

4. Messaging platforms. Use of WhatsApp, Messenger and Instagram through the Service is subject to Meta's terms and policies, including the WhatsApp Business Messaging Policy. Customers must connect only accounts they own or are authorised to manage. Thinky may suspend messaging features if a platform restricts or removes the Customer's account, or if Customer conduct puts Thinky's platform access at risk.

5. Acceptable use. Customers must not use the Service to send spam or unsolicited messages, to send unlawful, misleading or harmful content, to collect data without consent, to attempt to access other Customers' instances, or to interfere with the Service. Thinky may suspend accounts that breach these terms after notice where practical.

6. AI features. AI outputs are generated automatically and may contain errors. Customers must review AI content before relying on it and remain responsible for communications sent to their shoppers. AI usage is metered and charged as described in the Customer's package.

7. Fees. Fees, billing cycles and prepaid credits are set out in the Customer's order or the pricing page. Fees are payable in advance unless agreed otherwise. Unpaid amounts may lead to suspension after notice. Taxes are the Customer's responsibility where applicable.

8. Term and termination. Subscriptions run for the period selected and renew unless cancelled before the renewal date. Either party may terminate for material breach not cured within 14 days of notice. When a subscription ends, the Customer's workspace stays available read-only for 30 days so the Customer can export its data; the data is deleted 90 days after the subscription ended, as described in the Privacy Policy.

9. Availability and support. Thinky aims to keep the Service available continuously except for planned maintenance announced in advance. Support is provided by e-mail and in-app during business hours in Qatar.

10. Intellectual property. The Service, its software, design and documentation belong to Thinky and its licensors. Customers receive a non-exclusive, non-transferable right to use the Service during the subscription. Customers may not copy, modify, reverse-engineer or resell the Service.

11. Confidentiality. Each party keeps the other's non-public information confidential and uses it only for the purposes of these terms.

12. Warranties and liability. The Service is provided "as is" to the extent permitted by law. Thinky's total liability for any claim in a contract year is limited to the fees paid by the Customer in the preceding 12 months. Thinky is not liable for indirect or consequential loss, or for actions of third-party platforms.

13. Changes. Thinky may update the Service and these terms; material changes are notified at least 30 days in advance. Continued use after the effective date is acceptance.

14. Governing law. These terms are governed by the laws of the State of Qatar; disputes are subject to the courts of Qatar.
